JUSTICE SUDHIR SINGH ORAL ORDER 03-03-2017 Heard learned counsels for the petitioner, complainant and learned counsel for the State.

The petitioner is apprehending his arrest in connection with Complaint Case No. 184 of 2015 for the offences instituted under Sections 498(A) and 406/34 of the IPC.

The prosecution story, in brief, is that the complainant was married with this petitioner on 25.08.2008. After marriage, she went to Mumbai with her husband and started living there with her in-laws where Rs. 2,00,000/- cash and a motorcycle were demanded from the complainant and on refusal of the same, the

She came to know that her husband is not employed in Merchant Navy rather he was working as a Light man in the Film City. The complainant has two children. It is further alleged that on 08.01.2015, the accused persons forcibly given Phenyl to the complainant but anyhow her live could be saved for which she lodged a Sanha in Mumbai. She was also forcibly ousted from the house after taking her clothes and ornaments for which she also lodged a Sanha in Mumbai.

It has been submitted on behalf of the petitioner that the petitioner has got no criminal antecedent. There is no allegation of tampering with the witnesses alleged against the petitioner. He has falsely been implicated in the present case.

It has jointly been submitted on behalf of learned counsels for the petitioner and the complainant that they have mutually agreed to stay together. The petitioner undertakes to keep the complainant and her two children with all due respect and dignity.

Considering the fact that the petitioner and the complainant have mutually agreed to stay together, let the petitioner above named, be released on bail in the event of his arrest or surrender before the learned court below within a period

No.7110 of 2017 (3) dt.03-03-2017 3/3 of six weeks from today in connection with Complaint Case No. 184 of 2015 on furnishing bail bond of Rs. 10,000/-(Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned J.M. Patna City, Patna, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.

The complainant shall be present in the learned court below on the date of furnishing bail bond by the petitioner and the petitioner shall be obliged to take the complainant and her two children alongwith him with all due respect and dignity as per the submission made by him in this Court.
