JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER 10-04-2017 Heard learned counsel for the petitioner and learned A.P.P. for the State.

The petitioner apprehends his arrest in connection with Pauthu P.S.Case No. 82 of 2016 registered for offences punishable under Sections 379, 411 and 420 of the Indian Penal Code and Sections 3,4, 5 of Bihar Illegal Mining Act.

Accusation is that on 23.11.2016 in course of checking of the vehicle, the trucks bearing Registration No.UP 78BT 5277 and JH 09L 5054 loaded with stone chips were intercepted by the police.

Learned counsel for the petitioner submits that the petitioner is the owner of the Truck No.UP 78BT 5277 which was

The petitioner had no knowledge about loading of stone chips by driver at his truck.Co-accused Surya Kumar who is owner of the another truck has already been extended the privilege of anticipatory bail vide Cr.Misc. No.12989/17 on 23.3.2017.

Having considered the facts and circumstances of the case, let the petitioner, above named, in the event of his arrest or surrender before the court below within a period of four weeks from today be enlarged on bail on furnishing bail bond of Rs.10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate- II, Aurangabad, in Pauthu P.S.Case No.82/16,subject to the conditions as laid down under Section 438 (2) of the Code of Criminal Procedure.
