JUSTICE JITENDRA MOHAN SHARMA ORAL ORDER 10-04-2017 Heard learned counsel for the petitioner, learned counsel for the informant and also learned counsel for the State. The petitioner apprehends his arrest in connection with Bihta P.S. Case No. 863 of 2016, registered for the offences punishable under Sections 147, 148, 149, 307, 324 and 504 of the Indian Penal Code.
Allegedly, the petitioner and others after forming an unlawful assembly being armed with fire arms opened fire causing injuries to several persons, resulting, the injured were referred to P.M.C.H., Patna.
Submission is of false implication and that against the petitioner there no specific allegation, he has got no criminal antecedent, the petitioner has no concern with other co-accused
Patna High Court Cr.Misc. No.10984 of 2017 (3) dt.10-04-2017 2/2 and he has been named with oblique motive due to dirty village politics and, as such, the petitioner deserves sympathetic consideration.
The learned A.P.P. duly assisted by the learned counsel for the informant opposes the prayer of pre-arrest bail by submitting that the petitioner was also one of the member of that assembly who has opened fire upon the informant and others causing injuries to several person.
In the facts and circumstances as stated above, considering that against the petitioner there is no specific allegation and further that he has got no criminal antecedent and, as such, the petitioner in the event of his arrest or surrender within four weeks from the date of receipt/production of a copy of this order shall be released on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned A.C.J.M., Danapur, Patna in connection with Bihta P.S. Case No. 863 of 2016, subject to the conditions as laid down in section 438(2) of the Cr.P.C. (Jitendra Mohan Sharma, J.) Rajiv/- U T
