JUSTICE VINOD KUMAR SINHA ORAL ORDER 03-01-2019 The petitioners apprehend their arrest in connection with Katihar Sahayak P.S.Case No. 735 of 2018 registered under Sections 120B, 323,354, 406, and 420 of the Indian penal Code. Allegation as per FIR is that informant sold 11 kathas land on a total consideration amount of Rs. 29,37,500/-, out of which, Rs. 16,15,000/- was paid by the petitioner to the informant. Thereafter informant executed sale deed. But for the rest amount, petitioner issued a cheque in favour of the informant but the same was dishonoured and there is also allegation of outraging her modesty.
Submission of learned counsel for the petitioner is that petitioner has already given consideration money for the land which he has purchased and rest of the land has been sold to

Having heard both sides and in the facts and circumstances, as stated above, let the petitioners, abovenamed, in the event of arrest or surrender before the court below within a period of six weeks from the date of order, be released on bail upon furnishing bail bond of Rs. 25,000/- (Rupees twenty five thousand) each with two sureties of the like amount each to the satisfaction of the learned CJM, Katihar in connection with Katihar Sahayak P.S. Case No. 735 of 2018; subject to condition as laid down under Section 438(2) of the Code of Criminal Procedure.
