JUSTICE MOHIT KUMAR SHAH ORAL ORDER 02-03-2023 The present writ petition has been filed seeking the following reliefs:- "(a) For a direction to the District Public Grievances Cell, Siwan for construction of a Building of Primary School on the land appertaining to Khata No.68 and 62 Plot No.229 and 224 area 3 katha situated in villageMahammadpur, P.S.-Siwan Muffasil, District-Siwan as per the recommendation of the District Programme officer, Siwan vide his memo No. 5 dated 3.01.2014 contained in Annexure-6.

(b) For a direction to the District Magistrate, Siwan to allow the

Patna High Court CWJC No.16521 of 2014(2) dt.02-03-2023 2/2 petitioner to execute the deed of gift of the land of Khata No.68 and 62 Plot No. 229 and 224 total area 3 Katha in the name of the Hon'ble Governor of Bihar.

(c) For a direction to the respondents not to construct the school building on the land of Khata No. 43 Plot No.

668 as per recommendation of the Circle Officer, Sadar Siwan because the said land is the subject matter of a Title Suit No. 106/2010 pending in the Court of Sub-Judge, Siwan."

After some arguments, the learned counsel for the petitioner seeks not to press the present writ petition, however, seeks liberty on behalf of the petitioner to avail such other alternative remedies as are otherwise available under the law, for redressal of the aforesaid grievances.

Liberty so sought is granted.

The writ petition stands dismissed as not pressed.
