The petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 395 and 397 of the Indian Penal Code.
The FIR of road robbery is against unknown persons. Name of the petitioner has transpired in the confessional statement of the co-accused, namely, Gautam Kumar before the police. Submission of the petitioner is that co-accused Vikas Kumar @ Banti Goswami and another co-accused have already been allowed anticipatory bail by a Co-ordinate Bench of this Court in Cr. Misc. No. 12336 of 2016 vide order dated 25.05.2016.
Considering the aforesaid facts, let the petitioner,
Patna High Court Cr.Misc. No.12861 of 2017 (2) dt.17-03-2017 2/2 above named, in the event of his arrest or surrender before the Court below within a period of thirty days from the date of receipt of the order, be released on bail on furnishing bail bond of Rs.10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate 1st Class, Gaya/Successor Court in connection with Wazirganj Police Station Case No. 453 of 2015, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure as well as condition that the petitioner shall fully co-operate with the investigation and trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioner.
