2. This application has been filed on behalf of the petitioners for quashing the order dated 27.01.2018 passed by Executive Magistrate, East, Muzaffarpur in Misc. No. 933 of 2005 / Trial No. 102 of 2012.

3. Only ground urged by the learned counsel for the petitioner is that the impugned order has been passed without hearing him but from the entire copy of the order sheet of the concerned Court below it appears that on some dates, learned counsel for the petitioner had appeared and some dates the learned counsel for the petitioner was absent and thereafter

Patna High Court CR. MISC. No.5753 of 2019(3) dt.17-03-2025 2/2 the impugned order has been passed by the concerned Magistrate.

4. Upon perusal of the entire order sheet of the concerned Court below and also upon perusal of the the impugned order, this Court finds no illegality in the proceedings as the order has been passed after examining the materials available on record.

5. Accordingly, this application is dismissed with liberty to the petitioners to move the District Court concerned in civil jurisdiction if they are so adviced.
