The petitioner apprehends her arrest in Simultala P.S. Case No. 33 of 2016 registered for the offences punishable under sections 384 and 420 of the Indian Penal Code. The Block Education Officer, Jhajha inspected the school in which the petitioner was Incharge, Head Master. The informant alleged that the petitioner realized Rs. 800/- instead of Rs. 350/- which is Registration fees, for registration of the students.
Learned counsel for the petitioner submits that the petitioner was Incharge, Head Master and she has not taken charge from her predecessor, Niranjan Ram. In para 12 and 13 of the case diary only two students alleged to have paid excess amount to the petitioner, but the petitioner submits that she did not receive any
Patna High Court Cr.Misc. No.10837 of 2017 (3) dt.24-04-2017 2/2 excess money from any of the students.
Learned Additional Public Prosecutor opposed the prayer.
Having considering the facts, circumstances and the petitioner is a lady, the petitioner-Archana Thakur, in the event of her arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, is directed to be enlarged on bail on furnishing bail bond of Rs.10,000/- within two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Jamui in connection with in Simultala P.S. Case No. 33 of 2016, subject to the condition as laid down under section 438 (2) of the Cr. P.C. (Prabhat Kumar Jha, J) Mahesh/- U T
