JUSTICE VINOD KUMAR SINHA ORAL ORDER 03-01-2019 This is an application for grant of anticipatory bail in connection with Maranchi P.S. Case No. 89 of 2017, disclosing offences under Sections 457 and 380 of the Indian Penal Code and later on, added Section 411 of the Indian Penal Code. Allegation as per F.I.R. is that some thefts have committed theft in the house of the informant and taken away cash, ornaments, etc. Petitioner is not named in the F.I.R., later on his named transpired on confessional statement. Further it appear that the petitioner is accused in three other cases. Submission of learned counsel for the petitioner is that the petitioner has made accused in this case only on the basis of confessional statement. Moreover, he is accused in three other cases, but he is on bail in that cases. Heard learned A.P.P. also.

Patna High Court Cr.Misc. No.77853 of 2018(2) dt.03-01-2019 2/2 Having heard both sides, considering the above facts and circumstances and also considering the fact that the petitioner has criminal antecedent, I am not inclined to grant anticipatory bail to the petitioner, rather he should surrender before the learned court below and pray for regular bail, which will be considered on its own merit without being prejudice by order of this Court.

Accordingly, this application is dismissed.
