JUSTICE VINOD KUMAR SINHA ORAL ORDER 11-09-2019 Petitioner seeks bail in anticipation of his arrest in connection with Dharahra P.S. Case No. 148 of 2019 registered for the offences punishable under Sections 341, 323, 379, 307/34 of the Indian Penal Code.

Allegation against the petitioner is that he and other accused assaulted the petitioner and his brother by means of lathi.

Submission of the learned counsel for the petitioner is that FIR itself shows that the brother of the informant had come to the house of the petitioner and impugned order shows that injuries are lacerated one and nature of injury has not mentioned in the impugned order.

Heard learned A.P.P. also.

Having heard both sides, in view of the above facts

Patna High Court CR. MISC. No.57332 of 2019(2) dt.11-09-2019 2/2 and circumstances, let the petitioner, above named, in the event of his arrest or surrender before the Court below within six weeks, be released on bail on furnishing bail bond of Rs. 25,000/- (Rupees Twenty Five Thousand) with two sureties of the like amount to the satisfaction of learned J.M. 1st, class, Munger in connection with Dharahra, P.S. Case No. 148 of 2019 subject to the condition as laid down under Section 438 (2) of the Cr.P.C. and further condition is that one of the bailors of the petitioner shall be a local person having sufficient immovable property within the jurisdiction of the Court concerned.
