The petitioner apprehends his arrest in connection with Bakhri P. S. Case No. 208 of 2016 instituted under Sections 323, 324, 341, 379 and 308/34 of the Indian Penal Code. Allegation, in brief, is that the accused persons took the informant inside the house and assaulted him. The specific allegation against the petitioner is that he gave iron rod blow on the head of the informant.
Submission is that there exists land dispute between the petitioner and the informant and there is case and counter case and the earlier case was lodged by the petitioner's side and the allegation of giving iron rod blow on the head of the informant causing injury is simple in nature and except one case earlier
Patna High Court Cr.Misc. No.6669 of 2017 (2) dt.22-02-2017 2/2 lodged against the petitioner by the informant's side, there is no other case.
Having considered the aforesaid facts and circumstances, let the petitioner, named above, in the event of arrest or surrender before the court below within four weeks from today, be released on bail upon furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Begusarai in connection with Bakhri P.S.Case No. 208 of 2016; subject to the conditions laid down under Section 438(2) of the Code of Criminal Procedure, 1973.
