The petitioner seeks anticipatory bail in connection with Bettiah Town P.S.Case No. 866 of 2017, registered for offences punishable under Sections 365 of the Indian Penal Code. Allegation as per F.I.R. against the petitioner is that the brother of the informant went to Bus stand but he did not return and after search the informant guessed that his brother has been kidnapped and the charge sheet has been submitted under Sections 365, 364 and 302 of the Indian Penal Code. Submission of the learned counsel for the petitioner is that the petitioner has no criminal antecedent and the name of the petitioner transpires on the confessional statement of the co-accused and the petitioner has no criminal antecedent.
Patna High Court Cr.Misc. No.78382 of 2018(2) dt.08-01-2019 2/2 Learned A.P.P. opposes the prayer for bail.
Having heard both sides and in view of the facts and circumstances as discussed above, let the petitioner in the event of arrest or surrender before the court below within a period of six weeks from the date of order, be released on bail on furnishing bail bond of Rs. 25,000/- ( Twenty five Thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Bettiah in connection with Bettiah Town P.S.Case No. 866 of 2017, subject to the condition that as laid down under Section 438 (2) of the Code of Criminal procedure with conditions that one of the bailors of the petitioner shall be a local person having sufficient immovable property within the jurisdiction of the concerned court.
