2. Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State.

3. The petitioner is apprehending his arrest in connection with Judawanpur P.S. Case No. 31 of 2023 dated 18.03.2023 registered for the offences punishable under Sections 341, 323, 504, 506, 307, 379/34 of the I.P.C. and Section 27 of the Arms Act.

4. As per the prosecution case, on 09.03.2023, accused persons excluding the petitioner assaulted the son of the informant. When the informant came to rescue his son, he was

Patna High Court CR. MISC. No.63169 of 2023(2) dt.07-11-2023 2/3 also brutally assaulted by them. They also took Rs. 50,000/- from the informant and his son's shop. On 27.02.2023, the petitioner had threatened to assault him.

5. Learned counsel for the petitioner has submitted that the petitioner is innocent and has been falsely implicated in this case. The petitioner has three criminal antecedents as stated in paragraph no. 3 of the bail petition. There is general and omnibus allegation against the petitioner. There is no specific allegation against the petitioner. It is further submitted that coaccused Krishna Bhushan Singh @ Dilip Singh is alleged to have given an iron rod blow on the head of the informant and the injuries sustained by the informant and his son are simple in nature as it is evident from the injury report, annexed as Annexures 2 and 2/A to the bail petition.

6. Learned A.P.P. for the State has opposed the prayer for anticipatory bail of the petitioner.

7. Considering the aforesaid facts and circumstances of the case, let the above named petitioner, in the event of his arrest/surrender within a period of six weeks from today, be enlarged on anticipatory bail on furnishing bail bond of Rs. 20,000/- (Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned Court concerned,
