The petitioner seeks regular bail in connection with Salkhua P.S. Case No. 16 of 2018, registered for the offence punishable under Sections 341, 323 and 307/34 of the Indian Penal Code.

Allegation against the petitioner and other accused persons is of assault the father of the informant who died later on.

Learned counsel for the petitioner submits that petitioner is in custody since 24.07.2018 and has no criminal antecedent. The petitioner is suffering from mental disorder. Heard learned APP also.

Considering the aforesaid facts, I am not inclined to

This application is accordingly dismissed.

However, as there was submission and petitioner is suffering from mental disorder, learned trial court is directed to get him examined in terms of examine as per provision as contained in Chapter XXV of Cr.P.C. by medical board and once the report is received, he shall pass an appropriate order.
