2. The petitioner has preferred this application for grant of regular bail in connection with Sasaram (Town) P.S. Case No. 448 of 2025 dated 10.06.2025 registered for the offences punishable under Section 338, 336(3), 318(4), 303(2), 340(2), 3(5) of B.N.S.

3. As per the prosecution case, the informant alleges that he is the victim of a fraudulent marriage scam. The accused, including Banti Kumar (Petitioner), Pinki Devi, and Kajal Kumari, conspired to cheat him by arranging a fake marriage in exchange for Rs. 2.55 lakhs. After the complainant paid the money, the bride and the other accused persons fled away. One

Patna High Court CR. MISC. No.60877 of 2025(2) dt.15-09-2025 2/3 of the accused, Rajmuni Kuer, was caught by the complainant's sister. The prosecution contends that the accused conspired to cheat and defraud the complainant under the pretext of marriage.

4. Learned counsel for the petitioner has submitted that the petitioner is innocent and has falsely been implicated in this case. The petitioner has no concern with the alleged occurrence and was one of the participant in the engagement ceremony and nothing else. He further submits that no money was paid to the petitioner rather all transaction was made between the coaccused Pinki Devi and the informant. The petitioner has no criminal antecedent as stated in para 3 of the bail petition. The petitioner is in custody since 01.07.2025.

5. Learned A.P.P. for the State has opposed the bail petition of the petitioner.

6. Considering the aforesaid facts and circumstances of the case as well as the period of custody, and further considering that no transaction has been made on the part of the petitioner, the petitioner above-named, is directed to be enlarged on bail on furnishing bail-bond of Rs.20,000/- (Rupees Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Rohtas at Sasaram in

Patna High Court CR. MISC. No.60877 of 2025(2) dt.15-09-2025 3/3 connection with Sasaram (Town) P.S. Case No. 448 of 2025 with the following condition:

(I) The petitioner is directed to remain physically present before the learned Court below on each and every date, failing which on two consecutive dates without reasonable cause, the bail bond of the petitioner is liable to be cancelled.
