The petitioner seeks bail in a case under Section 302 and other sections of the Indian Penal Code.
The informant, father of the deceased, named one Gul Babu and alleged that he along with two unknown persons took the vehicle of his son (the deceased) on hire, but his son did not return.
It is submitted that the petitioner is not named in the F.I.R. Except suspicion, there is no material against the petitioner. In para 24 of the case diary, another driver disclosed that he had a talk with the deceased and the deceased disclosed that he was carrying Satyajit Singh and the petitioner, but thereafter the mobile of the deceased was found switched off. It appears that the police took print out of Mobile No.
Patna High Court Cr.Misc. No.7420 of 2015 (3) dt.31-03-2015 2/2 8002122322 of Satyajit Singh @ Prithvi Singh, who had a talk on Mobile No. 9576720604 and the said mobile belonged to one Sumitra Devi, mother of Shatrughan Rai. Except the fact that the petitioner happens to be a friend of Satyajit Singh @ Prithvi Singh, the investigating officer did not collect any material to show the involvement of the petitioner in the murder of the driver of the vehicle. Even the police submitted final form against Gul Babu, who is said to have taken the vehicle on hire. Considering the facts aforesaid, the above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Sitamarhi in Parihar P.S.
