The petitioner is in custody in connection with N.D.P.S. Case No. 51 of 2018 arising out of Motihari Town P.S. Case No. 608 of 2018 for the offences under Sections 399, 402, 120(B), 414 of the Indian Penal Code, Section 25(1-b)a, 26, 36 of the Arms Act and Section 16, 20, 22, 23 of the N.D.P.S. Act. Learned counsel for the petitioner submits that the petitioner has no criminal antecedent and he is in custody since 31.08.2018. He further submits that in the instant case 1 Kg. Ganja was recovered. He next contended that petitioner has no concern with the alleged recovery.

Considering the fact that he has no criminal

No.1129 of 2019(2) dt.04-02-2019 2/2 antecedent and arms was not recovered from the possession of the petitioner, the Court is inclined to grant bail to the petitioner, let the petitioner be released on bail on furnishing bail bonds of Rs.10,000/- (Rupees ten thousand) with two sureties of the like amount each to the satisfaction of Court of learned Sessions Judge-cum-Special Judge, East Champaran, Motihari in connection with N.D.P.S. Case No. 51 of 2018 arising out of Motihari Town P.S. Case No. 608 of 2018.
