The petitioners seek bail in a case registered under Sections 401, 413 & 414 of the Indian Penal Code. Allegedly, altogether seven motorcycles were recovered in this case.
It has been submitted on behalf of the petitioners that the petitioners have got no criminal antecedent. There is no allegation of tampering of witnesses alleged against the petitioners. The petitioners are in custody since 02-07-2019. The petitioners have been falsely implicated in the present case. The petitioners had no knowledge that the motorcycle, in question is
Patna High Court CR. MISC. No.57391 of 2019(2) dt.11-09-2019 2/2 a stolen property. The allegation, made in the FIR is denied by the petitioners. There is no compliance of Section 100 of Cr.P.C. On behalf of the State, it is submitted that the petitioners are named in the Complaint Case/F.I.R.
Considering the aforesaid facts and circumstances, let the petitioners, above named, be released on bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Motihari, East Champaran in connection with Pipra P.S. Case No. 261 of 2018.
