The petitioner is in custody since 12.01.2015 in connection with Manihari P.S. Case No. 39 of 2014 for the offence registered under sections 147, 148, 149, 341, 427 and 302 of the Indian Penal Code.
Learned counsel for the petitioner submits that there is no specific allegation against these petitioners and that there is history of litigation between the parties and petitioner is the own full brother of the deceased. It is further submitted that similarly situated co-accused persons namely, Md. Ysuf Ali @ Md. Yusuf @ Md. Yunus and Md. Sabir Ali @ Md. Sabbir, who are also said to be present at the place of occurrence have been extended the
Patna High Court Cr.Misc. No.10867 of 2015 (2) dt.25-05-2015 privilege of regular bail by this Court in Cr. Misc. NO. 49986 of 2014 vide order dated 03.03.2015.
Considering the aforesaid submissions and also the fact that petitioner has no criminal antecedent, let the petitioner, as mentioned above, be released on bail on furnishing bail bond of Rs.10,000/- with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Katihar in connection with Manihari P.S.
