Mr. Akbar Ali, APP ====================================================== CORAM: HONOURABLE MR. JUSTICE ANIL KUMAR SINHA ORAL ORDER 18-09-2019 Heard learned counsel for the petitioners and learned APP representing the State.

The petitioners apprehend their arrest in connection with Durgawati P.S. Case No. 131 of 2019, registered under Sections 147, 148, 323, 342, 353, 332, 333, 337, 338, 427 and 152 of the Indian Penal Code.

The allegation against the petitioners, as per FIR, is that while the police was on patrolling duty they got the information that two groups were fighting near the village

No.58783 of 2019(2) dt.18-09-2019 2/3 Kalyanpur and when the police reached there and tried to pacify the matter, members of both the groups started abusing and pelting stones upon the police, in which police vehicle got damaged and police personnel have also received injury. Learned counsel for the petitioners submits that the petitioners are not named in the FIR. He further submits that persons arrested disclosed the name of other accused persons. He further submits that persons who were named in the FIR have been granted anticipatory bail by this Court in Crl. Misc. No. 44469 of 2019 and Crl. Misc. No. 46185 of 2019. Learned counsel for the petitioners relying upon annexure-2 series submits that injuries caused to the victims are simple in nature.

After having heard learned counsel for the parties and taking into consideration the fact that the named accused persons have been granted anticipatory bail by this Court and the petitioners are not named in the FIR, I am inclined to grant anticipatory bail to the petitioners.

This application is, accordingly, allowed.

Let the petitioners, abovenamed, in the event of arrest or surrender before the court below within a period of four weeks from today, be released on bail upon furnishing bail

Patna High Court CR. MISC. No.58783 of 2019(2) dt.18-09-2019 3/3 bonds of Rs. 10,000/- each with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Bhabhua, Kaimur in connection with Durgawati P.S. Case No. 131 of 2019; subject to condition as laid down under Section 438(2) of the Code of Criminal Procedure.
