The petitioners seek anticipatory bail in connection with Forbesganj P.S. Case No. 795 of 2017, registered for offences punishable under Sections 147, 149, 341, 342, 332, 353, 427, 435, 504 and 506 of the Indian Penal Code and Section 27 of the Arms Act.

As per F.I.R., allegation against the petitioners and other accused persons have created road blockage and misbehaved with the police party and also damaged the police vehicle and created obstruction in discharging the official duty of the police party.

Submission of the learned counsel for the petitioners is that they have falsely been implicated in this case and F.I.R. has

No.78427 of 2018(2) dt.08-01-2019 2/2 been instituted against large number of persons and the similarly situated co-accused persons have been granted bail by a Co-ordinate Bench of this Court vide order dated 23.03.2018 passed in Cr. Misc. No. 9090 of 2018 and the petitioners have no criminal antecedents.

Learned A.P.P. opposes the prayer for bail.

Having heard both sides and in view of the facts and circumstances, as discussed above, let the petitioner, above named, in the event of their arrest or surrender, be released on bail on furnishing bail bonds of Rs. 25,000/- (Twenty five thousand)each with two sureties of the like amount each in connection with Forbesganj P.S.Case No. 795 of 2017, to the satisfaction of learned C.J.M., Araria subject to the conditions as laid down under Section 438 (2) of Cr.P.C. with condition that one of the bailors of the petitioner shall be a local person having sufficient immovable property within the jurisdiction of the concerned court.
