The petitioners apprehend their arrest in connection with Khirimore P.S. Case No.22/16 registered under Sections 304B/201/34 of the Indian Penal Code.
The accusation is of killing the daughter of the informant by her husband and in-laws due to non-fulfillment of dowry demand and to dispose of her dead body. Learned counsel for the petitioners submits that in fact, the petitioners are the father-in-law, mother-in-law, brotherin-law, & cousin maternal father-in-law of the deceased and
Patna High Court Cr.Misc. No.11875 of 2017 (2) dt.04-04-2017 2/2 theyhave been falsely implicated in this case with ulterior motive without any specific overt act. In fact the deceased died due to diarrhea, and funeral of the dead body of the deceased was done in presence of the informant. Further submission is that the petitioners are separate in mess from the husband of the deceased. Moreover, Anil Yadav, husband of the deceased has already surrendered before the court below on 03.04.2017. Having regard to the facts and circumstances of the case, let the above named petitioners, be released on bail, in the event of their arrest or surrender before the learned Court below within a period of four weeks from today, on furnishing bail bonds of Rs.10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of the learned A.C.J.M.-III, Danapur (Patna), in connection with Khirimore P.S.Case No.22/16, subject to the condition as laid down under Section 438(2) of the Cr.P.C.
