Heard the learned counsel for the petitioners and Mr. Gauri Shanker Gupta, learned Additional Public Prosecutor for the State.
The petitioners apprehend their arrest in connection with Jamui P.S. Case No. 463 of 2020 registered for offence punishable under sections 341, 323, 324, 325, 307, 504, 506/34 of the Indian Penal Code.
The learned counsel for the petitioners has submitted that both the parties have sustained grievous injuries and the
Patna High Court CR. MISC. No.70391 of 2022(3) dt.18-01-2023 2/2 petitioners are the persons of clean antecedents. He has submitted further that in counter case, co-accused persons have been granted anticipatory bail.
The anticipatory bail of the petitioners has been rejected, vide Cr. Misc. No. 50352 of 2021, as such, they are directed to surrender before the court below and make a prayer for regular bail, that shall be disposed of on the same day without being prejudiced by this order. The learned court below may take notice of the fact that on similar allegation, co-accused persons, in counter case, have been granted anticipatory bail.
