JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 18-01-2019 Heard learned counsel appearing for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner seeks bail in a case registered for the offences punishable under Sections 467, 468, 411 and 120-B of the Indian Penal Code and Section 25(1-B)a, 26 and 35 of the Arms Act.
Petitioner and some others were caught near a hotel, while they were fleeing after getting down from a Scorpio, which was stolen property.
However, submission on behalf of the petitioner is that having similar allegation, co-accused, namely, Uday Kumar Jha, has been granted privilege of bail by a co-ordinate Bench of this Court and one another has also been granted privilege of bail by this Court.

No.78776 of 2018(2) dt.18-01-2019 2/2 Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Muzaffarpur, in connection with Ahiyapur P.S. Case No. 879 of 2018.
