JUSTICE SANJAY PRIYA ORAL ORDER 06-03-2017 Heard learned counsel for the petitioner and the State. The petitioner apprehends his arrest in Katihar Town P.S. Case No. 437 of 2016 instituted for the offence under Sections 406, 420, 467, 468, 471/34 of the Indian Penal Code and Section 7(2) of Bihar Protection of Interests of Depositor's Act, 2013.

The Additional Collector Md. Jafar Rakiv alleged that on inspection of M/s. Alchemist Township India Ltd., New market, Katihar, he found various irregularities in the office as mentioned in the written report itself. It is alleged against the petitioner that he being the Assistant in the aforesaid firm, did not give any information with regard to the working of the company. It has been submitted on behalf of the petitioner that

Patna High Court Cr.Misc. No.9533 of 2017 (2) dt.06-03-2017 2/2 he was working as Data Entry Operator on contract basis since 1.3.2016 in the aforesaid Company. He has no concern with the working of the Company as he was not office bearer of the aforesaid firm.

Considering the facts and circumstances of the case, prayer for anticipatory bail of the petitioner is allowed. In the event of surrender/arrest of the petitioner, named above, within six weeks from today, in connection with Katihar Town P.S. Case No. 437 of 2016, he shall be released on anticipatory bail on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Katihar, subject to the conditions as laid down under Section 438 (2) Cr. P.C.
