The petitioner has prayed for bail in a case registered for the offence punishable under section 392 of the Indian Penal Code.

As per allegation in the FIR, while the informant was returning after collecting money of Fusion Micro Finance Pvt. Ltd. Company, three accused persons snatched his money and key of his motorcycle. On protest, all the accused persons assaulted him and fled away.

It is submitted by learned counsel for the petitioner that petitioner has been falsely implicated in this case. Petitioner is not named in the FIR. On the basis of suspicion, co-accused

Patna High Court CR. MISC. No.62230 of 2022(2) dt.17-02-2023 2/2 Panchu Das was arrested and he disclosed the name of the petitioner is his confessional statement before the police, which has no evidentiary value in the eye of law. Petitioner is languishing in custody since 20.09.2021.

The application for bail is opposed by learned APP for the State.

Having heard learned counsel for the parties and considering the facts and circumstances of the case, this court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Rs. ten thousand only) with two sureties of the like amount each to the satisfaction of the learned SDJM, Madhepura in connection with Srinagar P.S. Case No. 13 of 2021.
