JUSTICE VINOD KUMAR SINHA ORAL ORDER 27-02-2017 This is an application for grant of anticipatory bail for offences punishable under Sections 498A of the Indian Penal Code.

Heard learned counsel for the petitioner.

It has been submitted on behalf of the petitioner that he is husband in this case and there is allegation of demand of two lakhs rupees from the father of the complainant. Now petitioner is ready to keep his wife with full dignity and respect. Heard learned A.P.P. also.

Heard both sides. From perusal of the impugned order it appears that earlier also petitioner had moved for anticipatory bail before the court below, which was rejected and

Patna High Court Cr.Misc. No.8140 of 2017 (2) dt.27-02-2017 2/2 he was directed to surrender before the court below and make prayer for regular bail but petitioner again moved before this Court for anticipatory bail.

Considering the facts aforesaid, I am not inclined to grant anticipatory bail to the petitioner, the same is rejected. However, petitioner is directed to surrender in the court below, i.e., learned S.D.J.M., Bettiah, West Champaran, in Complaint Case no. 650 C of 2015 and make prayer for regular bail which will be considered on its own merit and also consider that if there is any chance of settlement between the parties without being prejudiced by the order of this Court. The present application stands disposed of.
