The petitioner seeks regular bail in Gopalganj Town P.S. Case No. 314 of 2014 registered under Sections 307, 379, 326 and other sections of the Indian Penal Code.

The informant Dharmendra Kumar named Rajesh Soni, Pintu Soni (petitioner) and Shambhu Soni and alleged that they asked him to stay in front of the shop of Rajesh Soni. As soon as the informant stayed at the shop, Rajesh Soni poured conc acid on his body. The petitioner is alleged to have pushed the informant while he was trying to escape as a result of which the informant fell down along with the motorcycle and thereafter the petitioner snatched a golden chain from his neck.

Learned counsel for the petitioner submits that the petitioner did not throw acid. The allegation of throwing acid is

Patna High Court Cr.Misc. No.4366 of 2015 (2) dt.02-02-2015 2/2 against Rajesh Soni, who has already been enlarged on bail vide Cr. Misc. No. 42845 of 2014 as simple injury was found on the body of the informant. The allegation of theft is against the petitioner.

Considering the facts aforesaid and the nature of allegations made against the petitioner and the fact that the petitioner is in jail since 29.11.2014 and he has got no criminal antecedent, the above named petitioner is directed to be enlarged on bail on furnishing bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Gopalganj in Gopalganj Town P.S. Case No. 314 of 2014.
