The petitioner is apprehending his arrest in connection with Akbarpur P.S.Case no.287 of 2010 dated 30.12.2010 registered for offences punishable under Sections 467, 468, 420, 120(B)/34 of the Indian Penal Code.

Allegation against the petitioner is that by impersonating the informant, he has got the sale-deed executed with respect to the land of the informant.

Submission of the learned counsel for the petitioner is that they have been falsely implicated in this case and the land has been mutated in the name of the petitioner also. Heard learned A.P.P. also,w ho has opposed the prayer for bail stating that the case is of the year, 2010 and the petitioner is named in the FIR in spite of that he has not appeared and now

Patna High Court Cr.Misc. No.78052 of 2018(2) dt.04-01-2019 2/2 after eight years, he has moved for anticipatory bail. Having heard both sides and in view of the facts and circumstances, as stated above, I am not inclined to grant privilege of the anticipatory bail to the petitioner, rather let the petitioner surrender before the learned court below within a period of six weeks from the date of order and make prayer for regular bail, which will be considered by the learned court below without being prejudiced by the order of this Court. With the aforesaid observation, this application is disposed of.
