The petitioners seek regular bail in connection with Bairiya PS case no. 340 of 2018 registered for the offence punishable under Sections 307, 353 and other sections of Indian Penal Code.

The allegation is regarding the police having received information from the informant that the petitioners along with others were engaging in scuffle and when the police party reached there, the accused persons had also assaulted the police party.

No.2090 of 2019(2) dt.17-01-2019 2/2 The learned counsel for the petitioners submits that as far as the present petitioners are concerned, there is a general and omnibus allegation against them and it is only the co-accused Manager Sah who had assaulted the informant. The petitioners are stated to be in custody since 11.09.2018. Having regard to the facts and circumstances of the case, I deem it fit and proper to enlarge the petitioner on regular bail.

Accordingly, the abovenamed petitioners are directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (rupees ten thousand) with two sureties of the like amount each to the satisfaction of A.C.J.M.-VII, Bettiah, West Champaran in connection with Bairiya PS case no. 340 of 2018.
