JUSTICE NAWNEET KUMAR PANDEY ORAL ORDER 02-08-2022 Learned counsel for the petitioner is directed to remove all the defects pointed out by the Stamp Reporter within one month. Heard learned counsel for the petitioner as well as learned APP for the State.
The petitioner apprehends his arrest in connection with Raxaul P.S. Case No. 297 of 2021, registered for the offences punishable under Sections 448, 353, 504, 506 of the Indian Penal Code. The informant is Anchal Adhikari. As per allegation, the petitioner entered into the office of the informant without permission and asked him to vacate the land of Bettiah Raj. When the informant asked him to produce the papers in respect thereof the petitioner started shouting and also made chaos in his office. Learned counsel for the petitioner has submitted that Anchal Adhikari was duty bound to vacate the land of Bettiah Raj and in

No.211 of 2022(2) dt.02-08-2022 2/2 this respect the petitioner has sent a number of representations to S.D.M., D.M. etc. and S.D.M. and D.M., vide their respective letters No. 665M dated 22.9.2017 and 1867/2017 directed the informant to conduct inquiry on the petition of the petitioner but he flouted the order of the S.D.M. and D.M., East Champaran Motihari and it was the reason that the informant lodged false case against the petitioner. He has falsely implicated the present petitioner in this case. Considering the above-mentioned facts and circumstances let the petitioner, in the event of his arrest or surrender within four weeks before the learned court below, be released on anticipatory bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned S.D.J.M., Raxaul, in connection with Raxaul P.S. Case No. 297 of 2021, subject to the conditions as laid down under Section 438(2) Cr.P.C.
Office shall ensure that all defects are removed by the petitioner within the stipulated time provided in para-1 hereinabove, failing which the matter shall be brought to the notice of this Court. (Nawneet Kumar Pandey, J) SONALI/- U T
