The petitioners are languishing in custody since 26.02.2015 in a case registered for the offences punishable under Sections 302 and 201/34 of the Indian Penal Code. The prosecution case is that on 10.11.2014 the informant's brother went the brick kiln at Bariyarpur but he did not return at night and subsequently his dead body was recovered. It is alleged against the petitioners and others that they earlier threatened the brother of the informant for not leaving the job at brick kiln.

It is submitted by learned counsel for the

Patna High Court Cr.Misc. No.22704 of 2015 (2) dt.10-07-2015 2/2 petitioners that only on suspicion the accusation has been levelled. A statement has been made in para 3 of the petition that the petitioners have no criminal antecedent and similarly situated coaccused Wakil Rai has been granted bail vide Cr. Misc. No. 10893 of 2015.

Considering the aforesaid facts, let the above named petitioners, be released on bail on furnishing bail bonds of Rs.10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of learned Sub-divisional Judicial Magistrate (West), Muzaffarpur in connection with Motipur P.S. Case No. 421 of 2014.
