JUSTICE VINOD KUMAR SINHA ORAL ORDER 31-01-2019 This is an application for grant of anticipatory bail in connection with Chandi P.S. Case No. 357 of 2016, disclosing offences under Sections 307 & 34 of the Indian Penal Code and later on Section 302 of the Indian Penal Code has been added. Allegation as per F.I.R. is that the daughter of the informant was found lying in unconscious condition in a field and thereafter she was taken to the hospital for treatment. Nobody named in the F.I.R., later on, the name of the petitioner transpired in this case and there is also allegation against her is of trying to delete the messages from the mobile phone of the deceased.
Submission of learned counsel for the petitioner is that except allegation of deleting the message from the mobile phone of the deceased, there is nothing against her. Further, she

Heard learned A.P.P. also, who has opposed the prayer for anticipatory bail of the petitioner.
Having heard both sides, considering the above submission, this application is allowed. Let the petitioner, above named, in the event of her arrest or surrender before the court below within six weeks, be released on bail on furnishing bail bond of Rs. 25,000/- (Rupees Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Biharsharif, in connection with Chandi P.S. Case No. 357 of 2016, subject to the condition laid down under Section 438(2) of the Code of Criminal Procedure. (Vinod Kumar Sinha, J) Amjad/- U T
