JUSTICE SANJAY PRIYA ORAL ORDER 22-03-2017 Heard learned counsel for the petitioner and the State. The petitioner apprehends her arrest in Laheriasarai P.S. Case No. 417 of 2016 instituted for the offence under sections 379 and 411 of the Indian Penal Code. It has been submitted on behalf of the petitioner that while she was shifting her house-hold articles from new quarter 23 to new Nurse hospital which was allotted to her vide memo no. 2983 dt. 12.7.2016. And when the petitioner went to see new quarter no.23 for the purpose of shifting she found that unauthorized occupants are in possession of the new quarter allotted to this petitioner and she got the same vacated forcibly by the police, thereafter, to wreck vengeance this petitioner has falsely been implicated in this case.
Patna High Court Cr.Misc. No.12183 of 2017 (2) dt.22-03-2017 2/2 From the written report itself, it appears that all articles were house-hold articles and seizure has been prepared by staff of the D.M.C.H, namely Dinesh Kumar.
It is mentioned in para-3 that the petitioner has no criminal antecedent.
Considering the facts and circumstances of the case, prayer for anticipatory bail of the petitioner is allowed. In the event of surrender/arrest of the petitioner named above, within six weeks from today, in connection with Laheriasari Case No. 417 of 2016, he shall be released on anticipatory bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Darbhanga, subject to the conditions as laid down under Section 438(2) Cr.P.C.
