JUSTICE DINESH KUMAR SINGH ORAL ORDER 24-07-2015 Petitioner is languishing in custody since 11.01.2015 in a case registered for the offences punishable under Sections 376/511, 448 of the Indian Penal Code. The prosecution case is that the petitioner made an attempt to ravish the informant.
It is submitted by learned counsel for the petitioner that petitioner is neighbour of the informant and due to some petty dispute the accusation has been levelled. The petitioner was assaulted at the hands of the informant's family and a complaint was filed by the petitioner's side. Moreover the investigation has already concluded.
Considering the aforesaid facts, let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief
Patna High Court Cr.Misc. No.25781 of 2015 (2) dt.24-07-2015 2/2 Judicial Magistrate, Barh, Patna in connection with Athmalgola P.S. Case No. 76 of 2014.
Since the petitioner is accused in one other case, let learned Court below cancel the bail bonds of the petitioner, if the petitioner gets substantially involved in similar nature of offence or defaults for two consecutive occasions during trial.
