JUSTICE NAWNEET KUMAR PANDEY ORAL ORDER 02-08-2022 Learned counsel for the petitioner is directed to remove all the defects pointed out by the Stamp Reporter within one month. Heard learned counsel for the petitioner as well as learned APP for the State.

The petitioner apprehends his arrest in connection with Buxar Muffasil P.S. Case No. 58 of 2020, registered for the offences punishable under Sections 25 (1-b)A, 25(1-AA), 26 and 35 of the Arms Act.

Learned counsel for the petitioner has submitted that coaccused Ajit Singh was arrested at the spot with arms and ammunition and he disclosed the name of the petitioner. Learned counsel for the petitioner has further submitted by referring paragraph No. 8 of the bail petition that co-accused Ajit Singh who named the present petitioner, in the year 2017 fired shot on the

Patna High Court CR. MISC. No.219 of 2022(2) dt.02-08-2022 2/2 petitioner and in this respect Udwantnagar P.S. Case No. 399 of 2017 was lodged by the father of the petitioner. As there was enmity between the present petitioner and co-accused Ajit Singh, he named the present petitioner in this case.

Considering the above-mentioned facts and circumstances, let the petitioner, in the event of his arrest or surrender within four weeks before the learned court below, be released on anticipatory bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Buxar in connection with Buxar P.S. Case No. 58 of 2020, subject to the conditions as laid down under Section 438(2) Cr.P.C.

Office shall ensure that all defects are removed by the petitioner within the stipulated time provided in para-1 hereinabove, failing which the matter shall be brought to the notice of this Court. (Nawneet Kumar Pandey, J) SONALI/- U T
