The petitioner is in custody in a case registered under Sections 364(A) and 120(B) of the Indian Penal Code. The prosecution case in, brief, is that the vehicle on which victim/kidnapped Vivek Kumar was forcibly riding, this accused petitioner and other accused person sat. The present accused person and other accused persons were riding on that vehicle. A threat message had been called on mobile set of victim Vivek Kumar for demanding cash amount of Rs. 5 lacs otherwise the victim will be killed.

On behalf of the petitioner, a supplementary affidavit has been filed annexing the statement of the victim recorded

Patna High Court Cr.Misc. No.25001 of 2015 (2) dt.23-07-2015 under Section 164 Cr.P.C, which may be kept on the record. From perusal of the statement of the victim u/s 164 Cr.P.C. , the petitioner has not been named in the said statement of the victim. Further, the petitioner is in custody since 4.3.2015 and the chargesheet has already been submitted in this case. Further other co accused has been granted bail, vide Annexure 2 to the present application.

On behalf of the State, it has been submitted that the petitioner is named in the FIR.

Considering the facts aforesaid, let above named petitioner be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned S.D.J.M., Sadar Munger in Kharagpur P.S.Case No.152 of 2014.
