The petitioner seeks bail in Chanpatia (Sirisia) Rail P.S. Case No. 311 of 2012, registered for the offences punishable under Section 302 and other Sections of the Indian Penal Code. The informant named seven persons Karim Ansari, Ansarul Ansari, Ishaq Ansari, Israj Ansari, wife of Israj Ansari, Salim Ansari and Harin Ansari and disclosed that they assaulted his mother calling her witch.

It is submitted that from perusal of the FIR itself it appears that the informant is not an eye witness of the occurrence. Phoolbano Khatoon wife of Israj Ansari has already been enlarged on bail vide Cr. Misc. No. 49951 of 2014. Co-accused Karim Ansari, Ansarul Ansari, Israj Ansari and Gawar Ansari have

Patna High Court Cr.Misc. No.11437 of 2015 (3) dt.22-05-2015 2/2 already been acquitted. The petitioner is in jail since 22.10.2014. Considering the facts aforesaid, the petitioner above named is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Bettiah, West Champaran in Chanpatia (Sirisia) Rail P.S. Case No. 311 of 2012.
