The petitioner apprehends his arrest in Baniyapur P.S. Case No.121 of 2018 registered under Sections 30(a) and 38 of Bihar Prohibition and Excise Act.

On secret information, the informant raided the house of Dhruv Singh and apprehended Dhruv Singh and 90 liters of different brands of Indian made foreign liquor was recovered from the house of Dhruv Singh. At the time of raid, two persons are said to have fled away. Dhruv Singh disclosed that the petitioner and Mantosh Kumar managed to flee away. The learned counsel for the petitioner submits that petitioner might have gone to the house of Dhruv Singh for usual talk but it cannot be conferred that the petitioner went there to purchase the liquor. Petitioner was not found fleeing

Taking into consideration the facts aforesaid, let the petitioner, above named, in the event of his arrest or surrender before the court below within a period of four weeks from the date of receipt of the order, be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned 11th Addl. Sessions Judge-cum-Special Court, Excise, Saran at Chapra in connection with Baniyapur P.S. Case No.121 of 2018, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
