JUSTICE JITENDRA MOHAN SHARMA ORAL ORDER 01-03-2017 Heard learned counsel for the petitioner and learned counsel representing the State.

The petitioner wants to renew his prayer of pre-arrest bail in connection with Maharajganj P.S. Case No. 35 of 2014, which was earlier rejected vide order dated 13.01.2015 passed in Cr. Misc. No. 26773 of 2014, on the ground that the petitioner is ready to deposit 30 % of the loss amount.

Learned APP opposes the prayer of pre-arrest bail by submitting that earlier prayer of pre-arrest bail of the petitioner was rejected vide order dated 13.01.2015 and now he does not deserve pre-arrest bail.

In the facts and circumstances stated above, if the petitioner deposits 30 % of the loss amount of Rs. 22,89,863.73/-

Patna High Court Cr.Misc. No.8594 of 2017 (2) dt.01-03-2017 in the account of the Bihar State Food Corporation, Siwan, then his prayer for regular bail after his surrender shall be considered sympathetically by the court below considering that in similar circumstances other co-accused in other cases have been granted bail and accordingly, with this observation this application is hereby disposed of.
