The petitioner has prayed for bail in a case instituted for the offence under Sections 379, 414, 467, 468, 471/34 of the Indian Penal Code.
As per allegation in the FIR, during vehicle checking, near Sun temple, Kako, two persons, on a motorcycle, were arrested and they disclosed that they are indulged in selling and purchasing of theft motorcycle. They disclosed the name of the petitioners and from their house stolen motorcycles were recovered.
It is submitted by learned counsel for the petitioners
Patna High Court CR. MISC. No.66249 of 2023(3) dt.02-11-2023 2/2 that petitioners have been falsely implicated in this case. This case is triable by judicial magistrate. They have committed no offence. Provision of Section 100 CR.P.C. has not been followed by the police officials while preparing the seizure list. Petitioners have got no criminal antecedent and they are languishing in judicial custody since 19.07.2023. The application for bail is opposed by learned APP for the State.
Having heard learned counsel for the parties and considering the facts and circumstances of the case, this court is inclined to enlarge the petitioners on bail after framing of charge. The above named petitioners are directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Rs. ten thousand only) each with two sureties of the like amount each to the satisfaction of the learned SDJM, Jehanabad in connection with Kako P.S. Case No. 239 of 2023.
