JUSTICE PRABHAT KUMAR JHA ORAL ORDER 21-08-2015 Heard the learned counsel for the petitioner, the learned counsel for the informant and the learned Additional Public Prosecutor.
The petitioner seeks bail in a case under Section 420 and other sections of the Indian Penal Code.
The informant alleged that the petitioner took Rs. 5 lacs from her for providing job to her son and also for installation of mobile tower in her land. Rs. 2, 20,000/- was given to the petitioner in the year 2010 and the remaining amount was given in the year 2013.
It is submitted that the informant has got no chit of paper to show that the petitioner ever received any money for providing job to her children. The petitioner is in jail since
Patna High Court Cr.Misc. No.34936 of 2015 (2) dt.21-08-2015 2/2 18.06.2015.
The learned counsel for the informant, however, opposed the prayer for bail and submitted that there is recording of mobile.
Considering the facts aforesaid and the nature of allegation made against the petitioner and the fact that the case relates to lending and borrowing of money that too for illegal purposes, the above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Nawada in Pakribarawan P.S. Case No. 123 of 2014.
