The petitioner is apprehending his arrest in connection with Kutumba P.S.Case No.91 of 2011 , registered for offences punishable under Sections 144 and 436 of the Indian Penal Code and Section 17 of the CLA Act.
FIR has been lodged against the unknown for damage of the mobile tower and later on the name of the petitioner has transpired during the course of investigation of the case. Submission of the learned counsel for the petitioner is that after seven years, the name of the petitioner has transpired during the course of investigation of the case. Heard learned A.P.P. also.
Having heard both sides and in view of the facts and circumstances, as stated above, let the petitioner, above named,
Patna High Court Cr.Misc. No.78797 of 2018(2) dt.11-01-2019 2/2 in the event of arrest or surrender before the court below within a period of six weeks from the date of order be released on bail on furnishing bail bond of Rs.25,000/- (Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of the learned CJM, Aurangabad in connection with Kutumba P.S.Case no.91 of 2011 subject to condition as laid down under Section 438 (2) of the Code of Criminal Procedure with further condition to co-operate in the investigation of the case. With the aforesaid observation, this application is allowed.
