JUSTICE JITENDRA MOHAN SHARMA ORAL ORDER 16-03-2017 Heard learned counsel for the petitioner and learned counsel representing the State.

Petitioner apprehends her arrest in connection with Manigachhi P.S. Case No. 95 of 2015 registered for the offences punishable under Sections 147, 148, 149, 341, 323, 324, 448, 354, 504 of the Indian Penal Code.

Allegedly, in the occurrence the petitioner assaulted with sickle which hit on left palm of the informant, resulting, he fell down on the earth and thereafter, all the accused person assaulted her with fist, slaps and lathi.

Submission is of false implication and that there is no allegation of repeating the blow, the petitioner has caused no any injury and false allegation has been levelled against her and moreover left palm was injured and as such the petitioner deserves sympathetic consideration. Learned APP fairly submits that there is allegation for causing single injury against the petitioner on the left palm. In the facts and circumstances stated above, the petitioner above named, in case of her arrest or surrender within four weeks from the date of receipt/production of a copy of this order, shall be released on bail on execution of bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned A.C.J.M.III-cum-Sub-Judge- VI, Darbhanga in connection with Manigachhi P.S. Case No. 95 of 2015, subject to the conditions as laid down under Section 438 (2) of the Cr.P.C.
