The petitioner seeks bail in a case registered for the offence punishable under Section 395 of the Indian Penal Code. The petitioner is not named in the FIR. Unknown dacoits are alleged to have committed dacoity of a truck carrying Britannia biscuits.
Submission is that name of the petitioner figured in the case during the course of investigation and the petitioner is also said to have confessed his guilt before the police. The petitioner is in jail since 11.03.2015, but he has not been put on test identification parade. Similarly situated co-accused persons have already been enlarged on bail.
Considering the facts aforesaid, the petitioner above
Patna High Court Cr.Misc. No.29933 of 2015 (2) dt.12-08-2015 2/2 named is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Madhubani in Sakri P.S. Case No. 48 of 2014.
