JUSTICE JITENDRA MOHAN SHARMA ORAL ORDER 20-03-2017 Heard the learned counsel for the petitioner, the learned A.P.P. for the State as also the learned counsel for the Victim.

In this application for anticipatory bail the petitioner apprehends his arrest in connection with Jogbani P.S. Case No. 59 of 2012/ G.R. No. 1935 of 2012 for the offences punishable under sections 365, 372, 120-B and 34 of the I.P.C. Allegedly, the petitioner and others kidnapped Sanju Kumari and Janki Kumari.

Submission on behalf of the petitioner is of false implication and that the petitioner has already solemnized marriage with the victim Janki Kumari and the co-accused Faiyaz Alam has performed his marriage with Sanju Kumari, the victim is

Patna High Court Cr.Misc. No.9169 of 2017 (3) dt.20-03-2017 2/2 living with the petitioner and out of the wedlock there is one child. The learned counsel for the victim has submitted that Janki Kumari is present in Court and she disclosed that she solemnized her marriage with the petitioner and is living with the petitioner as his wife.

In the facts and circumstances as stated above, the petitioner, in case of his arrest or surrender within four weeks from the date of receipt/production of a copy of this order shall be released on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of. A.C.J.M. Araria in connection with above mentioned case, subject to the conditions as laid down in section 438 (2) of the Cr.P.C.
