The petitioner is apprehending his arrest in connection with Alauli P.S. Case No. 209 of 2016, G.R. No. 1767 of 2016 for the offences instituted under Sections 341, 323, 325, 379, 504 and 506/34 of the IPC.
The prosecution story, in brief, is that on 17.08.2016 at 6.00 A.M., the petitioner alongwith co-accused persons broken the Tatti(fencing) of Aagan of the informant. It is further alleged that the accused persons are dominant persons and when the informant began to fence they assaulted him and his brother Dharmendra Ram. The petitioner also snatched chain of the informant's wife and also assaulted her and co-accused Susheela Devi took away

It has been submitted on behalf of the petitioner that the petitioner has got no criminal antecedent. There is no allegation of tampering with the witnesses alleged against the petitioner. The allegations made in the FIR are denied by the petitioner. Both parties are agnates. Due to family dispute, the present case has been instituted.
On behalf of the State, it has been submitted that the petitioner is named in the F.I.R.
Considering the aforesaid facts and circumstances, let the petitioner above named, be released on bail in the event of his arrest or surrender before the learned court below within a period of six weeks from today in connection with Alauli P.S. Case No. 209 of 2016, G.R. No. 1767 of 2016 on furnishing bail bond of Rs. 10,000/-(Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned C.J.M., Khagaria, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
