JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER 08-05-2017 Heard learned counsel for the petitioners and learned A.P.P. for the State.

The petitioners apprehend their arrest in a case registered under Sections 147, 148, 149, 323, 324, 307, 353, 283, 427, 332, 333, 337, 338, 341 and 504 of the Indian Penal Code. Accusation is that on receiving information about blockage of National Highway 28 due to occurrence of Marpeet in respect of land dispute, the police reached there and then on seeing the police party, mob started raising slogan and blocked the road by burning tyre. Out of mob, sixteen persons including these petitioners started pelting stone on police party in which three constables i.e. Manoranjan Kumar, Badsah Singh and

Patna High Court Cr.Misc. No.13485 of 2017 (2) dt.08-05-2017 2/2 Rabindra Choudhary sustained injuries. At that time Vinod Kumar Gupta and Munshi Lal Sah were arrested by the police. Learned counsel for the petitioners submits that though the petitioners are named in the FIR, no specific allegation has been attributed against them. Moreover, the petitioners have no criminal antecedent.

Having considered the facts and circumstances of the case, let, above named petitioners, in the event of their arrest/surrender in the court below within four weeks from today, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of learned Sub-Judge-13-cum- A.C.J.M., Muzaffarpur, in connection with Sakra P.S.Case No. 37 of 2016,subject to the conditions as laid down under 438(2) Cr.P.C.
