Mr.Umesh Lal Verma ====================================================== CORAM: HONOURABLE MR. JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 03-12-2025 At the outset, learned counsel for the petitioners seeks permission to withdraw this bail petition in respect of petitioner no. 2 namely Manoj Kumar.

2. The anticipatory bail petition stands dismissed as withdrawn, so far as petitioner no. 2 is concerned.

3. The petitioners (i.e. petitioner nos. 1, 3 & 4) apprehend their arrest in a case registered for the offence under Sections 126(2), 115(2), 109, 352 and 3(5) of B.N.S., 2023.

4. It is alleged that all the F.I.R. named accused persons including these petitioners abused and assaulted informant and when elder son and his wife came to save informant, they were also assaulted, causing severe injuries to them.

5. Learned counsel for the petitioners submits that informant is father of co-accused Manoj Kumar (earlier petitioner no. 2) and father-in-law of petitioner no. 2 and due to property dispute, scuffle took place between the parties. Injuries sustained by the injured are simple in nature. Case and counter case. Petitioner no. 3 & 4 are brother and mother of petitioner no. 1 and have got no concern with the alleged occurrence.

6. Learned A.P.P. for the State opposes the prayer for anticipatory bail.

7. In the facts & circumstances of this case, let petitioner nos. 1, 3 and 4, as named above, in the event of their arrest/surrender within a period of six weeks from today, be enlarged on bail on furnishing bail-bonds of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Nawada in connection with Rajauli P.S. Case No. 330 of 2025, subject to condition as laid down under Section 482 of the B.N.S.S., 2023.
