JUSTICE VINOD KUMAR SINHA ORAL ORDER 11-09-2019 This application, for grant of anticipatory bail, arises out of Koilwar P.S. Case No. 214 of 2019, disclosing offences under Sections 341, 323, 354, 379, 427, 448, 504, 506 and 34 of the Indian Penal Code.

Allegation against the petitioner is of trying to outrage the modesty of the informant and of threatening her. Submission of learned counsel for the petitioner is that he has falsely been implicated in this case and no such occurrence as alleged in the F.I.R. has ever taken place and the real fact is that the land of informant is situated beside the land of petitioner and when the petitioner demolished his house for construction of new house, in which, a dispute arose between the parties, thereafter, the informant has lodged this false case. Heard learned A.P.P. also.

Let the petitioner, above named, in the event of his arrest or surrender before the court below within six weeks, be released on bail on furnishing bail bond of Rs. 25,000/- (Rupees Twenty five Thousand) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Bhojpur at Ara, in connection with Koilwar P.S. Case No. 214 of 2019, subject to the condition laid down under Section 438 (2) of the Code of Criminal Procedure.
